Welcome to Mitratender. These Terms of Use ("Terms") are a legal agreement between you ("User," "Customer," "Subscriber," or "You") and Mitratender, governing your use of our website, applications, and services ("Services").

By using our Services, you agree to comply with these Terms. Please read them carefully before proceeding.

1. Scope of Services

Mitratender is an AI-powered tender discovery and bidding support platform that aggregates tenders from government and private procurement portals (including GeM, CPPP, state portals, and PSUs) into a single dashboard. We provide tools for tender discovery, personalized alerts, analytics, competitor insights, and compliance checks.

Our Services are informational and facilitative in nature. We are not a government procurement authority, nor do we guarantee tender allotments. Certain services (premium alerts, competitor analysis, advanced reports) are offered through paid subscriptions.

2. Eligibility

  • You must be 18 years or older to use Mitratender.
  • You must have the legal authority to represent the business/organization you register with.
  • By creating an account, you confirm that all details provided (business name, GST, PAN, MSME details, etc.) are true and accurate.

3. Account Creation & Responsibilities

  • You must register with a valid email, phone number, and business details.
  • You are responsible for keeping your login credentials confidential.
  • You agree not to share your account with others (unless on enterprise plans) or use another person’s account without permission.
  • You are fully accountable for all activities carried out using your account.

4. Subscription, Payments & Refunds

  • Some Services are available free of cost (limited tender view/downloads).
  • Premium features are accessible through paid subscription plans.
  • Payment Terms: Payments must be made in advance through secure RBI-compliant & PCI-DSS certified gateways. Subscription fees are non-refundable except under cases defined in our Refund Policy. Taxes (GST, etc.) will apply as per Indian law.
  • Mitratender reserves the right to suspend services for non-payment.

5. Permitted & Prohibited Use

You may use Mitratender only for lawful business purposes. Prohibited activities include:

  • Automated scraping, bots, or unauthorized data extraction.
  • Reselling, redistributing, or republishing data obtained from Mitratender.
  • Misuse of competitor analysis or alerts for unlawful purposes.
  • Uploading malicious code, attempting to hack, or disrupting Services.
  • Fraudulent bidding, false documentation, or non-compliant submissions.

Violation may result in account termination, legal action, and reporting to authorities.

6. Intellectual Property Rights

All content, design, code, algorithms, reports, and trademarks (including “Mitratender”) belong to Mitratender. You may use data and reports for internal business purposes only. Copying, reverse engineering, modifying, or distributing any part of the platform without written approval is strictly prohibited.

7. Service Availability & Updates

Mitratender aims for 99.9% uptime but does not guarantee uninterrupted access due to maintenance, upgrades, technical issues, or failures at third-party sources. Features may be updated, enhanced, or discontinued at our discretion. Advanced AI features (like competitor analysis) are informational and not legal guarantees.

8. Data Privacy & Security

Your data usage is governed by our Privacy Policy. We collect only necessary information and protect it with encryption, role-based access, and regular audits. While strong measures are taken, you acknowledge that no digital platform is 100% secure. Mitratender will promptly notify users of data breaches as per Indian DPDP 2023 and GDPR.

9. Third-Party Services & Links

Mitratender integrates with government procurement sites (GeM, CPPP, PSU portals). We do not own or control these sites, nor are we responsible for their content, availability, or accuracy. Access to third-party portals may require separate registration and compliance with their terms.

10. Limitation of Liability

Mitratender provides tender information on an “as-is, as-available” basis. We do not guarantee winning of tenders or the accuracy/completeness of data (which depends on third-party portals). We are not liable for loss of business, revenue, or profits from missed tenders, user misinterpretation, or damages from downtime, data loss, or glitches.

11. Indemnification

You agree to indemnify and hold Mitratender, its officers, employees, and partners harmless from claims, liabilities, or losses arising from your misuse of Services, violation of these Terms, or breach of legal obligations during bidding.

12. Dispute Resolution

Disputes will first be attempted to resolve amicably. If unresolved, disputes shall be referred to arbitration under the Indian Arbitration and Conciliation Act, 1996, conducted in Agra, Uttar Pradesh, in English. The arbitrator’s decision shall be final and binding.

13. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Exclusive jurisdiction lies with the competent courts at Agra, Uttar Pradesh.

14. Termination of Services

  • You may terminate your account anytime by requesting closure.
  • Mitratender may suspend or terminate accounts for breach of Terms, fraudulent/unlawful use, or non-payment of dues.
  • Upon termination, your access will cease, but obligations (e.g., payment, indemnity) shall survive.

15. Amendments

Mitratender reserves the right to modify these Terms at any time. Updates will be notified via website, email, or dashboard alerts. Continued usage after updates implies acceptance of revised Terms.
